My parents live here in the states (Illinois) while my grandfather recently passed away in Croatia. His estate is in probate right now in Croatia...being contested by my mother(here) and her step brother(there) vs. my grandfathers wife. We think the children will get somewhere around a third of the proceeds of the sale of his house.
My question is....
My mother would like to "disclaim" her portion of the inheritance so it flows directly to her children (us). Our attorney here told us this is permissable under Illinois law. The concern is what would happen under Croatian law if she "disclaims" her portion of the inheritance. Does Croatian law or Illinois law govern? If Croatian law governs, what is the consequence?

I understand that under Croatian law, your mother can disclaim her portion of the inheritance. Certainly Croatian Law would prevail on any assets located in Croatia
