BEWARE. I have just been unethically gazumped! A well known british agent operating in Dalmatia [Peljesac], finding and conveying houses for Brits, has encouraged a Croatian seller who had a contract already with the agent through whom I was buying my house [after many mnths search for the one that I loved] approached the seller and encouraged them to breach their contract and sell to him. I am taking legal advice at this time and depending on this will expose the names of those involved. I am sure that they may well be known to those who visit this website. Business is indeed business but foul play is not right and ultimately harms us buyers! The escalated price will presumably be put to a different buyer. Do others have such experiences? MP

I asked around a bit about this one, as gazumping is not common here. I'm told that it probably relates to something where two different members of the same family instructed two different agents and at different prices for the same property. Does this sound like what eventually emerged MP? As I said peviously, it was not a property that we had anything to do with; we don't have anything on the Peljesac, but it is often a small world.

I have been in croatia for a few months looking for property also in the same area and have come across a few stories from Brits who have bought and have subsequently found problems with their properties which should have been identified to them by the agent, a Brit too, maybe the same one. I am a little cuatious of buying in Peljesac. It also seems that the prices in that area have been pushed up quite high becuase so many brits have wanted to buy there so gazumping may be a feature ! Who was the agent involved .... would be helpful to know if you can say ..........._

Hi MP I don't know much about the croatian property market but in montenegro if you have paid a deposit and the seller decides not to sell to you then they are legally bound to pay you twice the deposit amount in compensation. While this would not get the house of your dreams back it would take the pain away somewhat. If this is an old yugoslav law then it may well still apply in croatia as well. The general rule in former yugoslavia is whoever puts money down first gets to buy.

It is exactly the same in Croatia. If the buyer pulls out, they are liable to lose their deposit; if the vendor pulls out they have to pay double the deposit.
