hi peter,
i am croatian born (split), but currently live in Australia. i am looking at buying a property in the center of town(split). i have found two places on the net through a real estate agent. i would like to know, if the property is selling through an agent is it less likely to have problems, (i.e. does the real estate investigate owner ship papers and all legal matters involved in seeling the property) as oppose to buying privately. also, because i am a croatian citizen will i have any exemptions from any legal issues or tax costs. Futhermore, if i choose to purchase in split i would like to use your company to represent me legally. do you have solicitors in split? if you could please refer me to some contacts in split it would be much appreciated.

Hi Mare
You say you are Croatian born but living in Australia. Do you hold a Croatian passport? If so, no problems, but if you don't and only hold an Australian one you will only be able to buy in a private capacity if you have permanent residence in Croatia, as arrangements are always on a reciprocal basis and Australia only allows foreigners, including Croatians, to buy there if there have permanent residence. You could still buy, but you would need to establish a Croatian company and do it in the name of the company. We can set up a Croatian company for you.
Unfortunately buying through an agent is no guarantee that paperwork is OK. Unfortunately all too many agents offer property, often claiming clean papers, when they have made no checks whatsoever on it and are simply repeating what a vendor has told them. We can check title for you.
The main advantage of holding Croatian citizenship is that you won't have any need to apply to the Ministry of Foreign Affairs and will be able to move quickly to registering title in the Land Registry. You will still be liable for the 5% property transfer tax, though.
